Agency Worker Rights in the UK

Agency workers have legal protections in the UK. Here's what you're entitled to.

The Agency Workers Regulations 2010

After 12 weeks in the same role with the same hirer, you're entitled to the same basic working conditions as if you'd been recruited directly. This includes: equal pay (same as a permanent worker doing the same role), same access to facilities (canteen, parking, childcare), and information about permanent vacancies. This is known as the '12-week rule'.

Rights From Day One

Even before the 12-week qualification period, you have these rights from your first day: Access to shared facilities (canteen, toilets, parking). Information about permanent job vacancies. Protection from unfair treatment. National Minimum Wage. Maximum 48-hour working week (unless you opt out). Rest breaks (20 minutes if working 6+ hours). Paid annual leave (accrued from day one).

Holiday Pay for Agency Workers

You're entitled to 5.6 weeks (28 days) of paid annual leave per year, pro-rata for part-time work. This accrues from your first day of work. Many agencies roll holiday pay into your hourly rate (typically 12.07% extra). Check your contract to see how your holiday pay is handled.

What to Do If Your Rights Are Breached

Step 1: Raise the issue informally with your agency. Step 2: Put your complaint in writing. Step 3: Contact ACAS (Advisory, Conciliation and Arbitration Service) for free advice. Step 4: If unresolved, you can take a claim to an employment tribunal. Keep records of all shifts worked, pay received, and communications.
